Wrongful Death case filed against Daycare for E. Coli Death of Child
In Greenwood, South Carolina, the family of a two-year-old boy has filed suit against a daycare after he contracted an E. Coli infection which progressed and led to his death. Initially, a teacher at the daycare exhibited symptoms of E. Coli but was allowed to return to work without testing to determine whether she was contagious. Further, the Department of Health and Environmental Control was not notified of her illness and return to work until seven days after she already returned to work. An investigation led by the South Carolina Department of Social Services cited the daycare for fourteen violations under state Child Care Licensing laws including failure to notify parents an employee had E. Coli. The lawsuit alleges the daycare failed to follow safety regulations and protocols which if followed would have prevented the young boy from contracting this fatal illness.
