FTCA claim filed against Hampton Virginia VA Medical Center for operating on wrong bone

A veteran has brought a claim against the VA Medical Center in Hampton, Virginia for performing surgery on the wrong bone in his foot. Last year the veteran presented with a broken foot and had surgery performed on the third metatarsal which installed a metal plate and screws. After attempting to return to work at the Norfolk Sheriff’s Office, the man heard a pop in his foot and sought treatment. Doctors discovered that the fourth and fifth metatarsals were fractured and the third metal tarsal which had the plates and screws in it was not fractured. The man has filed a claim for $2.15 million and is claiming the improper surgery has caused pain, nerve damage, and that he can no longer work.
