$1 million FTCA case settled in South Carolina
BARRETT V. U.S.A
In July 2015, Mike Nakamura settled a heavily disputed FTCA case for $1 million in South Carolina. Barrett v. U.S.A was a birth injury case brought against the U.S. Navy, arising out of a delay in delivery of a full-term baby. The delay in delivery ultimately deprived the baby of oxygen and caused a brain injury, which resulted in an in-utero stroke, cerebral palsy, and a seizure disorder. The USA denied liability and contested that the stroke was caused by the delay, but after fully litigating the case the USA agreed to settle the case at mediation for $1 million. A structured settlement is in place which will pay many millions of dollars for care needs over the course of the child’s life.
