Results
Karl Protil settled a wrongful death case for $1 million. A District of Columbia-area hospital failed to heed warning signs following minor surgery, when the patient became dizzy and short of breath.
In spite of this, the hospital failed to diagnose an impending pulmonary embolus. The patient sustained anoxic brain damage and died from her injuries.
Karl Protil settled a birth injury case against the U.S. Army in connection with a premature birth. The doctors at Eisenhower Army Medical Center near Fort Gordon, Georgia misread an obstetrical ultrasound in twin-to-twin transfusion case, resulting in premature labor and birth injuries.
Part of the proceeds were structured so the child will have future care needs met. The structure provided $8.6 million in future benefits to the child.
Mike Nakamura recently settled a case involving a tractor-trailer accident in Charles County. Our client was stopped at a red light in Waldorf, Maryland. The defendant, operating the tractor trailer, approached the intersection as his light turned yellow. He sped up, changed his mind and braked, causing the tractor trailer to violently twist and slide into the Plaintiff’s vehicle.
Our client, an 85-year-old woman, suffered a fractured pelvis, multiple soft tissue injuries and a cardiac-type event while in the hospital. We were able to resolve the claim pre-suit without litigation, securing our client a $540,000 settlement.
Mike Nakamura secured $5 million from the federal government for Jenifer and Sean Mochocki, a U.S. Air Force officer, and their baby. The settlement, which includes a combination of cash and structured annuities that will generate much more than $5 million for the Mochocki family, resolves a medical malpractice suit against doctors at a Florida naval hospital for failing to order a cesarean section despite signs of fetal distress over several hours, resulting in permanent brain damage to the baby.
“This settlement provides millions for the care of baby Mochocki, and it also provides payments to both parents. This was a very good outcome in the case, especially in an environment not known for significant pro-plaintiff awards,” Nakamura said.
This settlement is the latest in a consistent string of million dollar-plus results Mike Nakamura has achieved for birth and brain injury victims. Along with other cases in Florida, Nakamura has achieved seven-figure results for victims in Virginia, South Carolina and Texas.
Karl Protil settled a failure to diagnose lung cancer case, winning $800,000 for the victim. A Maryland radiology group failed to properly interpret a lung x-ray and CT scan, resulting in a two year delay in diagnosing lung cancer. The delay in diagnosis resulted in a stage change.
Karl Protil settled a wrongful death case involving a one year delay in diagnosing lung cancer, securing $900,000 on behalf of the victim’s family. The family settled the wrongful death case prior to trial.
